By using the 65PlusAdvantage.com website and our services, you agree that any and all disputes, claims, or controversies arising out of or related to this agreement or your use of our services (collectively, “Disputes”) will be resolved exclusively through binding arbitration.
Why We Use Arbitration
This arbitration policy means you are giving up your right to sue us in court, including the right to a jury trial. All Disputes will be settled individually, and you agree that there is no right or authority for any Dispute to be handled as a class action or collective proceeding.
The arbitration will be conducted under the rules of the American Arbitration Association (AAA) or another established arbitration organization agreed upon by both parties. The arbitration location will be mutually agreed upon or, failing that, set in a place reasonably convenient for both parties. The arbitrator’s decision will be final and binding.
If any part of this arbitration policy is found to be legally unenforceable, that part will be removed, but the rest of the policy will remain in full force. By agreeing to these terms, you confirm you understand and agree to resolve all disputes through binding arbitration rather than traditional court litigation.
